Our Local Marketplace
Digithrift is designed to support local, sustainable shopping by connecting buyers and sellers within our designated service area.
Unless expressly stated otherwise, Digithrift currently operates in Kingston, Ontario, and surrounding areas specifically approved by Digithrift. Our platform is intended for local transactions and local delivery. We do not offer nationwide shipping as a standard service. We reserve the right to determine eligible service areas, approve participating members, and update our operating locations as the platform develops. Users must provide accurate location information when registering, listing items, or placing orders. Listings from outside our approved service area may be rejected or removed.
Eligibility and Member Accounts
To access certain features, including creating a digital thrift store or listing items for sale, you may be required to register as a member.
By registering, you agree to:
- Provide accurate, current, and complete information.
- Maintain the confidentiality of your account credentials and member ID.
- Keep your account information up to date.
- Use the platform only for lawful purposes.
- Follow all applicable Digithrift policies and member rules.
- Notify Digithrift if you suspect unauthorized access to your account.
Members must not impersonate another person, create misleading store identities, submit fraudulent information, or use another member’s account without authorization. Digithrift may reject applications, suspend accounts, remove listings, or revoke membership where we reasonably believe a user has violated these Terms, our member rules, or applicable law.
Seller Responsibilities
Digithrift allows approved members to create their own digital thrift stores using their chosen store names and permitted branding.
Sellers are responsible for all items they submit or list for sale.
By submitting an item, you confirm that:
- You own the item or have the legal authority to sell it.
- The item is located within the approved Digithrift service area.
- All descriptions, prices, photographs, condition details, and other information are accurate and not misleading.
- You have disclosed any known material defects, damage, missing components, or other relevant limitations.
- The item complies with applicable laws and Digithrift’s listing rules.
- You have the right to use any photographs, logos, branding, or other content you submit.
Sellers must not list stolen goods, counterfeit products, prohibited items, recalled products where resale is prohibited, or items that violate applicable law or Digithrift policies.
Digithrift may review, edit for formatting, decline, suspend, or remove a listing at our discretion. Listing approval does not constitute a guarantee of an item's authenticity, quality, safety, or condition.
Listing Approval and Curation
Digithrift may use local stylists, thrift managers, or other designated reviewers to assess listings and help maintain the quality and character of the platform. References to items being “vibe-checked,” curated, reviewed, or approved describe our selection process and do not constitute a guarantee of authenticity, condition, value, safety, or suitability. Sellers remain responsible for the accuracy of their item information, and buyers should review all available descriptions and photographs before ordering. Digithrift reserves the right to decline or remove listings that do not meet our platform standards.
Product Information and Availability
All items offered through Digithrift are secondhand or pre-loved unless explicitly identified otherwise. Pre-loved items may show signs of previous use, wear, aging, or imperfections. We aim to present listings accurately, but photographs may not display every detail, and colours may appear differently depending on your screen. Items are subject to availability. A listing being visible on the website does not guarantee that an item remains available for purchase. Digithrift may correct listing errors, update product information, or remove unavailable items.
Orders and Payment
By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the selected payment method. Prices are displayed in Canadian dollars unless otherwise stated. Applicable taxes and any additional charges will be disclosed where required before you complete your purchase.
Orders are subject to acceptance and item availability. Digithrift reserves the right to cancel an order where necessary due to an error, suspected fraud, unavailable inventory, a listing violation, or another legitimate reason. If payment has already been collected for a cancelled order, any required refund will be processed in accordance with applicable law.
Payments may be processed through third-party payment providers. Their applicable terms and privacy policies may also apply.
Digithrift will identify any applicable delivery charges before checkout. Where free local delivery is advertised, the offer applies only to the stated eligible area and conditions.
Returns, Exchanges, and Refunds
Because Digithrift primarily features secondhand items, all sales are generally considered final unless the listing, order terms, or applicable law provides otherwise. Nothing in this section limits any non-waivable consumer rights. If an item arrives damaged, materially different from its listing, incorrect, or undelivered, contact Digithrift at digithrifter@gmail.com as soon as reasonably possible, including your order number and relevant photographs or details. We will review the circumstances and communicate the available resolution, which may include a refund, replacement where available, or another appropriate remedy.
Change-of-mind returns, exchanges, or cancellations are not guaranteed unless expressly offered for the relevant purchase. Refunds, where approved or legally required, will generally be issued to the original payment method. Processing times may depend on the payment provider.
Our Community and Prohibited Conduct
Digithrift is built around trust, sustainability, and local community connections.
Users agree not to:
- Submit false, deceptive, or misleading listings.
- Misrepresent an item's ownership, condition, authenticity, or availability.
- Engage in harassment, discrimination, threats, fraud, or abusive conduct.
- Attempt to bypass platform procedures in a way that violates an applicable agreement.
- Upload malicious software or attempt unauthorized access to our website or systems.
- Copy, scrape, redistribute, or misuse platform content without permission.
- Use Digithrift to facilitate unlawful transactions.
We may investigate suspected violations and take appropriate action, including removing content, restricting access, suspending membership, cancelling affected orders where appropriate, or contacting relevant authorities when required.
The 10% Community Contribution
Digithrift is committed to supporting local nonprofit organizations focused on homelessness. We intend to allocate 10% of qualifying orders to eligible local nonprofit charities supporting people experiencing homelessness and low-income housing. The applicable calculation, including the definition of a qualifying order, the amount used to calculate the 10%, treatment of taxes, discounts, delivery charges, cancellations, and refunds, will be explained in our published charitable contribution details. Where a contribution is advertised for a particular order, Digithrift will apply the stated terms to that order. Charitable organizations and contribution arrangements may change over time. Digithrift will update its public information when appropriate. The contribution does not automatically make the purchase a charitable donation by the customer or entitle the customer to a charitable tax receipt.
Digital Store Names, Branding, and Submitted Content
Sellers retain ownership of the intellectual property they own in their store names, branding, photographs, and submitted materials.
By submitting content to Digithrift, you grant us a non-exclusive, royalty-free licence to host, reproduce, display, format, and use that content as reasonably necessary to operate, promote, and administer the platform and your listings.
This licence lasts for as long as reasonably necessary for those purposes, subject to applicable law and legitimate recordkeeping requirements. Promotional use beyond the operation of your listing should be consistent with any additional permissions obtained.
You confirm that your submitted content does not infringe another person's rights or violate applicable law.
You must not use another seller's branding or content without authorization.
Intellectual Property
The Digithrift name, logo, website design, original copy, platform materials, and other Digithrift-owned content are protected by applicable intellectual property laws. Except where permitted by law or expressly authorized in writing, you may not copy, modify, reproduce, distribute, or commercially exploit Digithrift-owned content. Nothing in these Terms transfers ownership of Digithrift's intellectual property to users.
Third-Party Services
Digithrift may rely on third-party providers for website hosting, payment processing, analytics, communications, and other operational services. We are not responsible for independent third-party websites, services, or policies, except to the extent required by law. Your use of a third-party service may be subject to that provider's separate terms and privacy practices.
Website Availability and Limitations
We aim to keep Digithrift accessible and functioning properly but do not guarantee uninterrupted or error-free access. We may update, suspend, restrict, or discontinue features for maintenance, security, operational, or business reasons. To the extent permitted by law, Digithrift does not guarantee that every listing, seller, or item will meet a user's expectations. However, nothing in these Terms excludes any statutory obligation or consumer protection that cannot lawfully be excluded.
Liability
To the extent permitted by applicable law, Digithrift is not liable for indirect or consequential losses arising from use of the platform. Our responsibility for an order or service will depend on our role in that transaction, the applicable terms, and the law. We do not exclude responsibility for matters that cannot legally be excluded or limited. Nothing in these Terms removes any rights or remedies available to consumers under applicable legislation.
Indemnification
To the extent permitted by law, sellers and other users are responsible for losses, claims, or reasonable costs arising from their unlawful conduct, material breach of these Terms, infringement of third-party rights, or inaccurate information they provide.
This section does not require users to indemnify Digithrift for Digithrift's own negligence, unlawful conduct, or other liabilities that cannot legally be transferred.
Privacy
Your use of Digithrift is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.By using the platform, you acknowledge that personal information will be handled as described in that policy and in accordance with applicable privacy law.
Changes to These Terms
We may revise these Terms from time to time to reflect changes to our platform, services, policies, or legal obligations. The updated version will be published on our website with a revised effective date. Where required by law, we will provide additional notice or obtain consent. Your continued use of Digithrift after updated Terms take effect constitutes acceptance only to the extent legally permitted.
Governing Law
These Terms are governed by the laws of Ontario and the applicable laws of Canada. Any disputes will be handled by the courts with appropriate jurisdiction, subject to applicable consumer protection laws and any mandatory legal rights.
